APPROPRIATENESS OF HEALTH AND FITNESS TO COMMENCE AND COMPLETE THE 5k2PB PROGRAMME AND ANY SUGGESTED ACTIVITY OR CHALLENGES
The 5k2PB programme and any suggest activity or challenges on our website, blog and social media posts require you to exert yourself, potentially greater that you are currently used to. You must therefore have an appropriate base level of fitness (regular exercise, able to run 5km comfortably) prior to commencing. Regardless of your fitness ability we recommend that you seek medical advice before commencing the 5k2PB programme or suggested activity or challenges.
We recommend that you are aware and familiar of any running routes that you chose to train, in particular, you should know any hazards and dangers. As you exert yourself your body and concentration is likely to fatigue and therefore take extra care of our surrounds during the more demanding sections.
The following self-pre-exercise medical screening should be completed by yourself. If you answer yes to any of the following questions the programme may not be suitable for you. Please seek medical advice specifying the questions you answered yes for.
Self-Pre-Exercise Medical Screening 1. Do you have a history of heart problems? 2.Do you have a history of lung problems? 3.Have you had chest pains or tightness in the chest? 4.Do you suffer from exercise induced asthma or other respiratory problems? 5.Do you suffer from headaches/fainting/ dizziness? 6.Do you have pain/limited movement in any joint that could be made worse by a change in your physical activity? 7.Do you have diabetes? 8.Do you have epilepsy? 9.Have you had a recent operation/chronic illness/injury? 10.Are you pregnant / post-natal? 11.Do you know of any other reason why you should not do physical activity? 12.Is there a history of heart problems in your family? 13.Do you have high blood pressure? 14.Do you have a back problem that could be made worse by a change in your physical activity? 15.Do you smoke? 16.Are you currently taking any medication?
By agreeing to these terms and conditions you are agreeing to the following statements:
My state of health and physical condition is such as not to involve any risk to myself and I have an appropriate level of fitness (regular exercise, able to run 5km) to commence and complete the 5k2PB programme.
I am aware of and understand the potential risks associated with physical exercise and I am voluntarily partaking in these activities with knowledge thereof.
I have sought medical advice and confirm I am fit to proceed with the programme.
I am aware and understand that my body and concentration will fatigue during exercise and have ensured I am aware of the routes to run and risk assessed the route for hazards and dangers.
I have completed the self pre-exercise medical screening question to the best of my knowledge and belief and confirm that there is no reason why I cannot commence the programme.
I understand that if there is a change in my condition at all, I must stop following the programme immediately.
Without prejudice to the above, 5k2PB accepts no liability for loss, damage or injury of whatsoever nature and howsoever arising caused to me or suffered by me whilst following the 5k2pb programme, UNLESS such loss or liability is caused by a negligent act of 5k2PB.
LIMITATION OF OUR LIABILITY
1. use of, or inability to use, our site and 5k2pb pdf; or
2. use of or reliance on any content displayed on our site or 5k2pb.
We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it. You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software. We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. Where our site and content contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources.
The online community is currently based in a private Facebook group. We are not responsible for any breaches to this platform. Therefore, you join Facebook and the group under your own risk. We reserve the right to change the tool we use at any time.
As a purchaser of 5k2PB you are entitled to “Free lifetime access” to this group. Lifetime is defined as the life span of the group and we reserve the right to remove the group at any time without prior warning.
The group is designed to provide accountability and support. We expect you to also contribute and provide both to other members, although it is not mandatory to contribute. Within the group you must conduct yourself in well-mannered fashion at all times. We may revoke your access to the group immediately should you harass, threaten or abuse 5k2PB (including their staff) or other members of the group. If your access is revoked no refunds will be provided.
Refunds will be given as part of the following guarantee to improve your 5k time over the 4 weeks only. The guarantee has the following conditions:
• Your initial current 5km time must be sent to with the date at which it was set.
• This initial start time must have been set within a maximum of one month of Day 1.
• The programme must be followed in its entirety
• Your end time must be as at the end of the 4 weeks
• Specific refund request must be received within the timescales detailed below.
• Evidence of completion of the programme (GPS images, social media posts, dates at which accountability emails were sent) must be provided.
Refunds are not available for any other reason.
Requests for refunds should be made to firstname.lastname@example.org. Evidence of completion of the programme must be provided including. Refunds requests need to be received by the earliest of:
6 weeks from the initial starting time email sent; and
8 weeks from purchase date.
Note, specific refund requests must be received prior to refunds being considered. Refunds will not be processed solely on receiving an initial and end time email to email@example.com. This is due to the refund being based on satisfaction also. i.e. Refund requests would not be expected if you have learned a lot and/or have got value out of the online community but you have not improved your time over the 4 weeks.
CHANGES TO TERMS AND CONDITIONS
We may reasonably revise these Terms from time to time. We will endeavour to provide you with reasonable advance notice where this is appropriate due to the nature of the revision. We will notify you on the website or via email.
